Sorry to be negative but I can’t see anyone getting the result you want from the FOS. So many people saying ‘the FOS will side with you’….will they? Based on what?

Take a long hard look at the cases that have been upheld (there’s only a couple). These were only upheld due to exceptional circumstances, for example, not being able to withdrawal deposits made (which qualifies). The majority are declined with the reasoning that gambling transactions are not available for chargeback, end of story.

Obviously delighted for anyone who has success but better to be a realist about this.

I’m currently starting my chargeback process journey but not holding out for much.

I have a gambling block on my account and other health/mental issues that contribute to my actions.

I will see what happens but I am not holding out for it, and if it fails this will be my last attempt and I will be moving on from this thread and hopefully continue to never gamble again.

In any of my cases once the FOS got involved they raised them ! Ive got issues as well currently on a referral on gamcare with one to one sessions im not saying im a nut but ive got mental issues with gambling and im on every block possible moses casinos online gamstop gambling block on debit card

The two cases that we all refer to have two key points. One is a credit card whereby gambling is automatically blocked so an incorrect code is valid and the credit card company should chargeback, this is how I got my money back via Barclays.

And the other one a gambling block was on the card therefore the incorrect code worked for that person via the FOS decision, Chase have done this for me on my other chargeback.

I deal with FOS via work, (unrelated to these issues) and you do need to ensure you cover all points otherwise they will likely side with the bank. Gambling isn’t excluded by VISA/Mastercard or I can’t find it in the terms which I have read numerous times, but you will need to ensure you relay these things to the FOS. If you have used a credit card you should win, if you have a gambling block you should also win. If you haven’t mentioned gambling and the banks refuse on goods not received again I think you will win.

If gambling mentioned and bank refuse then you will need to ensure you check the FOS decisions that have lost and try not to repeat the words in that and use a different tactic, most appear to have failed as they complain the bank should have blocked the transactions that only applies if arguing the code bypassed a block, none of the unsuccessful FOS decision’s mention goods not received therefore that is the route I would go for, even if you have mentioned gambling no goods were received so maybe that would work.

Deffo lay it on thick loads of info and focus on illegal activities and mental state etc and yes mention all blocks but there should be one rule for all non Uk sites are not permitted to take money from us and it is instantly covered for a refund then that would stop them doing it !

I have an open case with the Ombudsman at the moment. I'm worried they're going to decline me despite all the evidence I have provided. Mine were made on a debit card and I don't think I had a gambling block applied to my card at the time of the transactions. Do you think there's anything else important I should highlight to them?

Just highlight you were preyed on and they used illegal methods to take the money

that's the route I've taken already. That I know I am a problem gambler, but that's why I have method's in place to ensure I cannot gamble and these online casisno's are using illegal methods to bypass these blocks.

Yes that is about it bud not much else you can put forward ive not went to FOS yet i did it years ago against Nationwide but they had already raised the chargebacks after i complained but they lost a few so i went to FOS stating they never did all they could to win them and answered the complaint late I got £200 compo for that but they ruled the bank did all they could on the chargebacks the problem was the casino site owned the payment provider

Virgin credit card is good they just raised mine no hassle just added info on the app then its raised for CSSKINSPRO only £300.25 but one back on the scum

filefileHi boots yes stated gambling site operating illegally miscoding fraud etc loaded up emails of chasing them up Kinghills im planning using it to buy a new mattress i was meant to get before i did this relapse im clear on the card nothing to pay so it will show as an over credit will wait the few weeks hopefully this will make sumup take note now on the rest

Agreed they shouldn’t be offering services in this country as it is illegal, however FOS won’t get involved in that and same as the banks they blank you when you say about the Gambling Act and illegal activity.

Potentially mention you were on Gamstop and that you were targeted, not sure what codes etc you could argue on if no gambling block on but revert to show me the goods I was meant to receive and haven’t. The issue as we have all discussed before is the bank should be charging back, that is the route to argue with FOS it’s not a legal right to chargeback but good practice if it was to succeed and in all our cases it would.
