I was honest with the bank and I said they were gambling transactions and I got a rejection from the bank. Then I ask the bank to raise the chargeback under goods not received. I stated that when tried to raise the initial chargeback, I mix-up the text while I copy/paste the text for a case with a different bank. Bank rejected. Now I'm with FOS. Email from Financial Ombudsman:

Below is the information I need in relation to your evidence of the MCC codes used by Chase.

I need clarification on the complaint itself. I note you have another complaint with our service regarding Revolut so I need to understand what this complaint with Chase is about as you stated in your complaint form that there was a mix-up involving Chat GPT when raising a complaint to both companies.

I need clarification on whether your complaint is in relation to the practices of an online casino or in relation to submitting a chargeback request for goods not received. This is key as I may have to look into the complaint differently depending on what the essence of the complaint is.

If it is in relation to gambling/practices of the online casino, From you I'd need to evidence to document that the wrong code was used by the merchant. Without evidence of this, It would be difficult to say that Chase made a business error as there would be no evidence that the wrong code was used. This is important if the complaint is in relation to this as I will need to see if a block on your Chase account would have blocked the transactions depending on the code used.

 

If in relation to goods not received, From you I'd need clear evidence that you didn't receive the goods/service. The card issuer's (Mastercard) rules are very restrictive and a lot of evidence regarding you not receiving the goods/service would need to be provided to me so that this can be taken into consideration. Without this evidence, It's difficult to say that the merchant didn't do what they said they would provide. Here at the service we can confident of our position on this but it is dependent on what evidence is provided by consumers like yourself to prove that this was the case as it is evidence based.

 

I'll be reviewing Chase's overall handling of the chargebacks but it is dependent on what your complaint is in relation to and the evidence provided regarding if it is in relation to gambling or goods not received.

 

I've also reviewed the website "BOXPVPMC.it", it seems to be in relation to gaming where you obtain in gaming features not gambling? Please can I have your comments on this too.

At this point I am struggling. Don't know what to say to FOS. Already asked for SAR from the bank specifically MCCs used for those transactions, but no reply yet.

Edit: And yes, there's a gambling block on my account since the first day I registered with Chase.

Given the circumstances I would say you need to be honest with FOS mate! State that you have bank blocks in place, state that the wrong MCCs were used so they could avoid the blocks etc. Think that is your only chance now.

The only casino I used is Maximum Casino.

This casino as the others on here are using third party to disguise the transactions.

I had (still have) blocks on my Chase and Revolut accounts.

I went through this same thing with the FOS and they eventually sided with the bank. Even had a psychiatric report done to show that I wasn't in control of my actions during this dark time. I totally understand your points made. On the flip side, if a person who is going to hunt down a none gamstop casino, its good to know which ones are safe to play on.

I wish I had found Guru before I tried to find safe none gamstop casinos. It's a sad state of affairs, but i'd rather be safe than sorry. With this said, I hope recovering addicts do not come looking and maybe Guru can remove the mention of accepts UK players, even if it's true and just have a forum post made by members.

I agree to a point, I am now on my second period of Gamstop self exclusion but somehow I always find a way around it.


during my second period, around two months ago I relapsed pretty heavily as a result of a casino I found through Casino Guru


it has its uses, and the advice on here is helpful, but the way they advertise casinos as ‘accepting uk casinos’ without having licensing is awful

The problem is we don’t always go looking for them. They share our personal data illegally and spam us endlessly! I don’t think there is any such thing as a safe Non Gamstop casino as a safe and compliant casino would geoblock and not advertise in the UK as they would be aware it is illegal to do so without a UKGC licence. Those that advertise themselves as Non Gamstop can never be trusted as they are immediately confirming they have a complete disregard for the laws and regulations and have no issue breaking them!

Sorry to hear about your relapse. I lost my marrige over relapses and took out loans to get through a really rough patch in my life.

Every none gamstop casino I have played on, I have had the courage to ban myself from that paticular casino.

I did a quick search for none gamstop casinos, which I obviously did in the past using google and Guru didn't show at all. Loads of sites offering different casinos.

I did my own search on this site and came across a forum post by a member on this site asking for info on safe sites. Lots of replies including some from myself.

I agree Guru should perhaps not let its members know that none UKGC casinos accept U.K players and this might make a small difference.

I don't understand how you found a site if you didn't go looking for one?

Yeah I hate the constant spam by text and email and sometimes a random call.

This is my own personal experience. I have found some sites that seem excetionally safe and do have good safe gambler tools. But as you said they could be passing our info about which is awful.


I just hope I don't go looking again as I believe I have exhusted all available sites and I am not banned from them all.
