Ich habe den LuckyFruits-Willkommens-/Einzahlungsbonus aktiviert, der mir zu diesem Zeitpunkt zur Verfügung stand.
Meine Beschwerde richtet sich nicht dagegen, dass ein Casino keine Gewinnobergrenze festlegen darf. Es geht vielmehr darum, wie mir diese Grenze bei der Annahme des Bonus präsentiert wurde.
In den speziell für diese Aktion geltenden Teilnahmebedingungen, die zum damaligen Zeitpunkt direkt unter dem Bonusangebot angezeigt wurden, erklärte LuckyFruits ausdrücklich:
„Der maximale Gewinn mit einem aktiven Einzahlungsbonus beträgt 50.000 NOK."
Allerdings gab es nur in diesen gesonderten Allgemeinen Bonusregeln eine weitere Bestimmung, die besagte, dass die maximalen Gewinne auf das Fünffache des Bonusbetrags begrenzt sind.
Ich verfügte daher über zwei unterschiedliche Informationen:
Aktionsbedingungen: Maximaler Gewinn 50.000 NOK
Separate allgemeine Bonusregeln: 5x der Bonusbetrag
LuckyFruits hat später durch Anwendung der 5x-Regel etwa 26.000 NOK von meinem Guthaben abgezogen.
Ich kontaktierte LuckyFruits und fragte gezielt nach dieser Diskrepanz. Die Antwort lautete, dass 50.000 NOK lediglich als „absolute Obergrenze" zu verstehen seien und die 5x-Regel immer dann Anwendung finde, wenn das Fünffache des Bonusbetrags unter 50.000 NOK liege.
Diese Unterscheidung wurde jedoch in den Aktionsbedingungen, als ich den Bonus annahm, nicht erwähnt. Hätte die Aktion geheißen: „Maximale Gewinne betragen das Fünffache des Bonusbetrags, begrenzt auf 50.000 NOK", wäre mir die Einschränkung klar gewesen.
Seit ich die Beschwerde eingereicht habe, hat sich außerdem eine wichtige Entwicklung ergeben:
LuckyFruits hat die direkt unter dem Bonus angezeigten Bedingungen geändert.
Die aktuellen, aktionsspezifischen Bedingungen besagen nun ausdrücklich:
„Maximale Gewinne mit einem aktiven Einzahlungsbonus sind auf das Fünffache des Bonusbetrags begrenzt."
Der Hinweis auf die 5-fache Prämie wurde bei der Annahme des Bonus nicht angezeigt. Damals lautete die entsprechende Aktionsbedingung 50.000 NOK.
Mir ist bewusst, dass eine nachträgliche Änderung des Wortlauts nicht automatisch beweist, dass die vorherigen Bedingungen ungültig waren. Ich halte sie jedoch für äußerst relevant, da der neue Wortlaut die genaue Einschränkung klar darlegt, die zur Abbuchung von ca. 26.000 NOK von meinem Kontostand geführt hat.

The bonus I activated was the LuckyFruits welcome/deposit bonus that was available to me at the time.
My complaint is not that a casino cannot have a maximum-win restriction. The issue is how the restriction was presented when I accepted the bonus.
In the promotion-specific Terms and Conditions shown directly under the bonus at the time, LuckyFruits explicitly stated:
"Maximum winnings with an active deposit bonus are NOK 50,000."
However, only in those separate General Bonus Rules was there another provision stating that maximum winnings are limited to 5x the bonus amount.
I therefore had two different pieces of information:
Promotion-specific terms: NOK 50,000 maximum winnings
Separate General Bonus Rules: 5x the bonus amount
LuckyFruits later removed approximately NOK 26,000 from my balance by applying the 5x rule.
I contacted LuckyFruits and specifically questioned this discrepancy. Their response was that NOK 50,000 should only be understood as an "absolute cap", and that the 5x rule applies whenever 5x the bonus amount is below NOK 50,000.
However, that distinction was not stated in the promotion-specific terms when I accepted the bonus. If the promotion had stated "Maximum winnings are 5x the bonus amount, capped at NOK 50,000", the restriction would have been clear to me.
There has also been an important development since I submitted the complaint:
LuckyFruits has now changed the terms displayed directly under the bonus.
The current promotion-specific terms now explicitly state:
"Maximum winnings with an active deposit bonus are limited to 5 times the bonus amount."
This 5x wording was not displayed there when I accepted the bonus. At that time, the corresponding promotion-specific term stated NOK 50,000.
I understand that changing the wording afterwards does not by itself prove that the previous terms were invalid. However, I believe it is highly relevant because the new wording clearly communicates the exact restriction that resulted in approximately NOK 26,000 being removed from my balance.
